By accessing or using Offsite Caller's services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use our services. These terms apply to all users, including contractors, business owners, and their authorized employees.

2. Service Description

Offsite Caller provides an AI-powered lead qualification service that:

• Monitors your connected Thumbtack account for new leads
• Makes automated voice calls to leads using AI technology
• Qualifies leads based on project requirements
• Delivers qualified lead information to your designated CRM or tools

3. Platform Usage Rules

When using Offsite Caller, you agree to:

• Provide accurate business and contact information
• Maintain valid authorization for connected third-party accounts
• Use the service only for legitimate business purposes
• Not attempt to reverse-engineer or exploit our AI systems
• Comply with all applicable laws regarding automated calling and lead generation

4. AI Limitations

You acknowledge that our AI voice agent:

• May occasionally misunderstand or misinterpret lead responses
• Cannot guarantee successful contact with every lead
• May not capture all relevant project details in every conversation
• Is not a replacement for human judgment in final business decisions

We continuously improve our AI, but it is not perfect. You are responsible for verifying lead information before committing to projects.

5. User Responsibilities

You are responsible for:

• Maintaining the security of your account credentials
• Ensuring your business is properly licensed and insured
• Following up with qualified leads in a timely manner
• Comlying with Thumbtack's terms of service
• Paying any applicable subscription or usage fees

6. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for service interruptions due to third-party platform outages (e.g., Thumbtack downtime), network issues beyond our control, or force majeure events.

7. Payment Terms

Pricing and payment terms will be provided upon service activation. Subscriptions are billed in advance and are non-refundable for the current billing period. We reserve the right to change pricing with 30 days notice.

8. Limitation of Liability

To the maximum extent permitted by law, Offsite Caller shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, or business opportunities. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Offsite Caller from any claims, damages, or expenses arising from your use of the service, your violation of these terms, or your violation of any third-party rights.

10. Termination

Either party may terminate service with 30 days written notice. We may immediately suspend or terminate your access if you violate these terms. Upon termination, we will provide your data export upon request for 30 days.

11. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance of the updated terms.
